Draft Decision

On 28 June 2018, the ACCC issued a Draft Decision on ARTC's application to vary its 2011 Hunter Valley Access Undertaking, and invited submissions on the Draft Decision.

Submissions are due by 27 July 2018.

Private health insurance report 2016-17

This report analyses key competition and consumer developments and trends in the private health insurance industry between 1 July 2016 and 30 June 2017, including ACCC enforcement and other actions relating to the health sector.

Request for regulatory forbearance to extend In-Train Order arrangements

In-Train Order (ITO) arrangements provide customers with a longer period before mandatory disconnection occurs where a valid order is in place for migration to the NBN.

On 1 June 2018, Telstra requested regulatory forbearance to extend the operation of existing ITO arrangements for standard voice and broadband services (which were due to expire on 30 June 2018) until 12 November 2018.

Domain Name Corp and Domain Name Agency to pay $1.95 million in penalties

The Federal Court has ordered that Domain Corp Pty Ltd and Domain Name Agency Pty Ltd (also trading as Domain Name Register) pay combined penalties of $1.95 million for breaching the Australian Consumer Law.

From November 2015 to at least April 2017, the two Domain Companies sent out approximately 300,000 unsolicited notices to businesses, which looked like a renewal invoice for the business’s existing domain name. Instead, these notices were for the registration of a new domain name at a cost ranging from $249 to $275.

New instruments

On 23 May 2018, the ACCC made two new digital broadcast radio facilities legislative instruments. These are the Digital Radio Multiplex Transmitter Licences (Decision-Making Criteria) Determination 2018 and Digital Radio Multiplex Transmitter Licences Procedural Rules 2018.

Commercial construction unit

The ACCC is currently prioritising anti-competitive conduct in commercial construction markets and has established a Commercial Construction Unit (CCU) focussed on the construction sector.
