Subject: Third line forcing
notifications N99013 - N99016 lodged by Hobart City Council
[DLM=For-Official-Use-Only]
Security Classification: For Official Use Only
Dear Ms Townsend
I refer to the third line forcing
notifications lodged with the Australian Competition and Consumer Commission
(the ACCC) by Hobart City Council on the 4th and 7th of April
2016. They have been allocated the registration numbers N99013 through
to N99016. The notifications and this email will be placed on the ACCC’s public
register which is available on the ACCC’s website.
The protection from legal
action provided by the notifications commences automatically 14 days after the
lodgement date, in this case on the 18th of April for N99013-N99015
and on the 21st of April for N99016, unless the ACCC objects.
On the basis of the information that you have
provided, and that the
parties will disclose all relevant terms and conditions to customers, the ACCC
does not object to the notifications at this time.
If
at any time circumstances change, or the ACCC receives further information,
such that it is satisfied that the public benefits from the third line forcing
conduct do not outweigh the public detriments, the ACCC may remove the
protection provided by the notifications.
Please
contact Theo Kelly on (02) 6243 1179 or by email to
adjudication@accc.gov.au if you have any
questions about this matter.
Regards
Mr Baethan Mullen
