FAD inquiries - Non-price terms & conditions & supplementary prices

Draft decision 25 March 2015

On 25 March 2015, the ACCC released its draft decision on the non-price terms and conditions for the:

  • fixed line services and the wholesale ADSL service
  • mobile terminating access service (MTAS)
  • domestic transmission capacity service (DTCS).

The draft decision also includes price terms for connection charges for fixed line telecommunication services. The ACCC has also published a public version of the consultant’s report on connection charges commissioned by the ACCC and information provided by Telstra on the cost of its connection works.

The ACCC has previously consulted on the non-price terms and conditions on the above services by releasing a position paper and a discussion paper.

The ACCC has also released a draft final access determination (FAD) instrument for fixed line services. This draft instrument includes non-price terms and fixed line connection charges in addition to the fixed line services primary price terms as set out in the ACCC’s draft decision on 11 March 2015.

The ACCC has decided to extend the date for submissions on the draft decision and the attached draft FAD instrument until 5 pm on 8 May 2015.

In deciding on this extension, the ACCC has taken into account the large amount of industry consultation on a range of complex matters across the three FAD inquiries, other concurrent industry processes and industry requests for more time to consider the issues. While the fixed line services FAD inquiry is now unlikely to be completed by the end of June 2015, the ACCC will continue to work towards a timely conclusion to this inquiry.
