NBN Co - special access undertaking 2012

On 8 October 2013, the ACCC issued NBN Co with a notice to vary under section 152CBDA of the Act. This notice was given in order to facilitate NBN Co being able to lodge a varied SAU that meets the statutory criteria under Part XIC.

The ACCC also published an explanatory statement that outlined the key changes that were made when finalising the notice and addresses the views put forward in submissions to the draft notice to vary.

On 19 November 2013, NBN Co lodged a varied SAU in response to the ACCC’s notice to vary. Under section 152CBDA(3) of the Act, the ACCC must consider a varied SAU given in response to an ACCC notice to vary instead of the December 2012 SAU.
