The ACCC released draft guidelines for consultation in 2006, but did not proceed to finalise these guidelines as it considered that its participation in Copyright Tribunal proceedings would both test its new role under the Copyright Act and further inform the development of the guidelines. The ACCC considers it is now an opportune time to revise the draft Copyright Guidelines and move towards issuing final guidelines.

Regulations made under section 32B of the Australian Postal Corporation Act 1989 allow the ACCC to inquire into disputes about the terms and conditions, including price of access to Australia Post’s bulk mail services.

Non-discrimination under Part XIC Communications Guideline Ongoing
April 2012

Non-discrimination provisions were introduced into Part XIC of the Act as part of the National Broadband Network (NBN) reforms.

The non-discrimination provisions apply to NBN corporations (such as NBN Co) and providers of Layer 2 bitstream services over designated superfast telecommunications networks (collectively referred to as 'network access providers').

Copyright Guidelines 2006 Communications Guideline Ongoing

In November 2006 the ACCC released draft copyright guidelines to assist the Copyright Tribunal in the determination of copyright remuneration. Public submissions were due by 31 January 2007.

Record keeping rules for Australia Post Postal services Guideline Finalised
November 2006

Part 4A of the Australian Postal Corporation Act 1989 allows the ACCC to issue record keeping rules to Australia Post.

Local number portability review & pricing principles Communications Guideline Finalised

The ACCC has outlined a number of pricing principles guidelines to refer to if required to arbitrate a number portability dispute.
