On 13 December 2013 the ACCC accepted NBN Co's Special Access Undertaking (SAU). The SAU commenced on 13 December 2013 and will expire in 2040.

On 23 May 2014, the ACCC commenced a public inquiry into making a final access determination (FAD) for the domestic transmission capacity service (DTCS). The ACCC has commenced consultation on the primary price terms, with the release of a consultation paper on 23 July 2014.

The ACCC is consulting separately on non-price terms and conditions for the DTCS. On 25 March 2015, the ACCC released its draft decision on non-price terms and conditions, following a joint consultation process for a number of declared services, including the DTCS.

On 11 September 2014, the ACCC commenced a declaration inquiry into whether a superfast broadband access service, such as the very-high-bit-rate digital subscriber line (VDSL) service, should be regulated under the Competition and Consumer Act 2010.

On 11 July 2013 the ACCC commenced a combined public inquiry into making final access determinations (FADs) for a number of the fixed line services and the wholesale ADSL service (FAD inquiry). The fixed line services are the:

The ACCC has commenced consultation on non-price terms and conditions and supplementary pricing issues for a number of related declared services:

  • fixed line services and wholesale ADSL service
  • mobile terminating access service (MTAS)
  • domestic transmission capacity service (DTCS)

Given these inquiries will cover a number of related issues regarding non-price terms and conditions and supplementary pricing issues, the ACCC considers there are benefits in conducting a combined consultation process on these issues.

On 7 November 2014, the ACCC commenced a public inquiry into varying the 2012 domestic transmission capacity service (DTCS) final access determination (FAD).

On 17 December 2014, the ACCC concluded its inquiry into the variation of the 2012 DTCS FAD and released a final report. The ACCC has decided to vary the 2012 DTCS FAD so that it applies to the three regional routes and seven exchange serving areas re-regulated under the 2014 DTCS declaration. The varied 2012 DTCS FAD will commence on 1 January 2015 and will expire when a new DTCS FAD comes into operation.

On 17 April 2014, the ACCC commenced a public inquiry into varying the final access determinations (FADs) for the unconditioned local loop service (ULLS), line sharing service (LSS), wholesale line rental (WLR) service and local carriage service (LCS) to reflect the changes to the scope of fixed line services regulation.

This inquiry considered whether the ACCC should vary the LCS and WLR service FADs to reflect the ACCC’s recent decision to remove the regulatory ‘carve outs’ for the central business districts of Sydney, Melbourne, Brisbane, Perth and Adelaide.

This project page contains Telstra’s submission of required measures 1(a) and 1(b), which relate to ‘pull through’ NBN connection processes, and includes the ACCC’s consultation and assessment of these measures.

These required measures were approved by the ACCC on 21 May 2014 and are now part of Telstra’s migration plan. See Measures 1(a) & 1(b) approved.
