On 8 May 2019, NBN Co lodged a proposed variation to its Special Access Undertaking (SAU) with the ACCC. The Competition and Consumer Act 2010 (CCA) allows NBN Co to give the ACCC a variation to an SAU already in operation. The ACCC accepted NBN Co’s current SAU on 13 December 2013, following an extensive consultation process.

Domestic transmission capacity service final access determination inquiry 2019 Communications Access determination Ongoing

On 5 June 2019, the ACCC released a consultation paper to formally commence a public inquiry into making a final access determination (FAD) for the domestic transmission capacity service (DTCS). The consultation paper seeks industry views on the pricing approach that the ACCC should adopt for the DTCS and the appropriate prices for newly-defined transmission route services, such as backhaul to regional mobile base stations.

The ACCC is holding a public inquiry under section 497 of the Telecommunications Act 1997 (Cth) on whether to extend, vary, or revoke the current domestic mobile terminating access service (MTAS) final access determination (FAD).

NBN Points of Interconnect POIs Communications Review Ongoing

Non-discrimination under Part XIC Communications Guideline Ongoing

Non-discrimination provisions were introduced into Part XIC of the Act as part of the National Broadband Network (NBN) reforms.

The non-discrimination provisions apply to NBN corporations (such as NBN Co) and providers of Layer 2 bitstream services over designated superfast telecommunications networks (collectively referred to as 'network access providers').
