SBAS Final Access Determination Inquiry 2016

On 29 July 2016, the ACCC commenced a public inquiry to make a final access determination (FAD) for the superfast broadband access service (SBAS) following its decision to declare the SBAS. The ACCC also issued an interim access determination (IAD) for the SBAS.

The ACCC combined the SBAS FAD inquiry with the existing local bitstream access service (LBAS) FAD inquiry, under section 152BCJ(1) of the CCA.

The combined SBAS and LBAS FAD inquiry considered the appropriate price and non-price terms and conditions for access for these services.

On 15 September 2016, the ACCC released a consultation paper for this combined SBAS/LBAS public inquiry.

On 9 January 2017, the ACCC released its draft decision and draft SBAS and LBAS FADs for comment. Submissions on the draft decision and FADs closed on 17 February 2017.

On 24 March 2017, the ACCC issued a further consultation paper on three proposed modifications to the pricing approach prior to making a final decision on the SBAS and LBAS FADs. Submissions on the further consultation paper closed on 7 April 2017.

On 26 May 2017, the ACCC released its final report on its inquiry to make FADs for the SBAS and LBAS declared services, and its final decision on the FADs.
