On 1 September 2016 the ACCC extended the inquiry period for making a final access determination (FAD) for the Local Access Bitstream Service (LBAS) until 7 April 2017.
The ACCC decided to extend the LBAS FAD inquiry as it was unable to complete its inquiry within the previous extension.
This is because the ACCC considered it is appropriate to undertake consultation on the LBAS FAD following the conclusion of the Superfast Broadband Access Service (SBAS) declaration inquiry.
On 29 July 2016, the ACCC announced that it had declared an SBAS and commenced a public inquiry into making a final access determination for this service (SBAS FAD). On the same day, the ACCC also commenced an SBAS FAD inquiry and decided to combine the SBAS FAD inquiry with the current LBAS FAD inquiry, under section 152BCJ(1) of the Act.
On 15 September 2016, the ACCC released a discussion paper for the combined SBAS/LBAS FAD inquiry.
The further extension of the inquiry will allow the ACCC to undertake appropriate consultation on issues relating to both the LBAS FAD and SBAS FAD.
