Fixed line services

Under the Competition and Consumer Act 2010 (the Act), the ACCC is able to declare and make final access determinations for listed carriage services if it considers it is in the long term interests of end users for it to do so. The ACCC regulates seven fixed line services.

26 May 2017

On 7 April 2015, the ACCC commenced an access determination inquiry in relation to the Local Bitstream Access Service (LBAS) as required under the Competition and Consumer Act 2010 (the CCA).

On 20 July 2011 the ACCC made FADs for the declared fixed line services. The FADs are backdated to commence on 1 January 2011 and expire on 30 June 2014.

SBAS Final Access Determination Inquiry 2016 Communications Access determination Finalised

On 29 July 2016, the ACCC commenced a public inquiry to make a final access determination (FAD) for the superfast broadband access service (SBAS) under section 152BC of the Competition and Consumer Act 2010 (the Act). This followed the release of the ACCC’s decision to declare the SBAS on 29 July 2016.

The Telecommunications Legislation Amendment (Competition and Consumer) Act 2020 received Royal Assent on 25 May 2020. Among other provisions, it amends the Telecommunications Act 1997 (Cth) (Tel Act) to enable superfast fixed line broadband networks serving residential customers to operate on a functionally separated basis (rather than a structurally separated basis).

The ACCC's strategic review commenced in December 2005 as an inquiry to examine the future regulation of certain fixed network services. In April 2007, the ACCC began a second stage of the review with the release of a position paper outlining a framework for the review of existing fixed services regulation and the principles that will guide future regulatory decisions.
