On 9 July 2020, the ACCC released a public discussion paper commencing a public inquiry into whether the following services should continue to be declared:
- superfast broadband access service (SBAS)
- local bitstream access service (LBAS).
Submissions closed on 4 September 2020.
On 18 December 2020, the ACCC released a draft decision for comment. The ACCC invites submissions in response to the draft decision by Friday 19 February 2021.
Under the Competition and Consumer Act 2010 the ACCC must review the current SBAS declaration before it expires in July 2021.
The current LBAS declaration does not expire — however, it is open to the ACCC to decide whether to vary, revoke, make a new declaration or allow the current declaration to remain in-force.
