Telstra retail price control arrangements

Under the Telecommunications (Consumer Protection and Service Standards) Act 1999, Telstra has been subject to various retail price control arrangements made by the Minister for Communications between 2005 and 2014.

Price controls

The Minister revoked the retail price control arrangements on 18 March 2015 as a result of a number of regulatory reviews undertaken for the Department of Communications that indicated the price controls had reduced in relevance over time.  The Minister for Communications retains retail price control powers and can reintroduce retail price controls at any time.

The retail price controls applied to a range of Telstra’s fixed-line voice services limiting Telstra’s ability to increase prices for three baskets of services and 10 connection products, setting price caps for untimed local calls and the basic line rental service. The ministerial determination also imposed metro/regional price parity requirements and conditions on the pricing of line rental provided to schools and charities.

Annual reporting

Under the Competition and Consumer Act 2010 (the Act), the ACCC must report to the Minister annually on the adequacy of Telstra’s compliance with the price control arrangements. The ACCC does not, in practice, report to the Minister, if there is no ministerial determination setting out retail price controls in force.

The ACCC commenced its inquiry in September 2000 and released a discussion paper on 29 September 2000.

In order to facilitate further discussion by interested parties, the ACCC issued a draft report identifying a set of draft recommendations in December 2000. The final report was published in February 2001.
