Copyright Guidelines 2019 Communications Guideline Finalised

The ACCC released draft guidelines for consultation in 2006, but did not proceed to finalise these guidelines as it considered that its participation in Copyright Tribunal proceedings would both test its new role under the Copyright Act and further inform the development of the guidelines. The ACCC considers it is now an opportune time to revise the draft Copyright Guidelines and move towards issuing final guidelines.

On 28 June 2018 ARTC submitted an application to vary its 2008 Interstate Access Undertaking by four months until 21 December 2018.

On 3 July 2018 the ACCC sent a letter to stakeholders seeking comments on ARTC's proposal. Submissions were due by 17 July 2018.

On 25 July 2018 the ACCC consented to ARTC's variation application.

On 5 March 2018 the ACCC commenced an inquiry into the Domestic Transmission Capacity Service (DTCS) including whether to extend, vary or revoke the DTCS declaration.

NBN Co SAU variation 2017 Communications Access undertaking Finalised

On 22 June 2017, NBN Co formally withdrew its original SAU variation lodged with the ACCC on 27 May 2016. NBN Co simultaneously lodged a new proposed variation to its SAU (revised SAU variation).

On 2 August 2017, the ACCC released a consultation paper on the revised SAU variation.

On 25 January 2018, the ACCC extended its decision making period in respect of NBN Co’s proposed SAU variation.

On 29 May 2017, Riordan Grain Services submitted an application to be exempted from Parts 3 to 6 of the Port Terminal Access (Bulk Wheat) Code of Conduct. The ACCC sought additional information from Riordan Grain Services and a revised application was lodged on 31 May 2017.

On 28 July 2017, the ACCC released a final determination granting exempt service provider status to Semaphore at its port terminal facility at Osborne Berth 1, Inner Harbour, Port Adelaide . Exempt service providers don't have to comply with Parts 3 to 6 of the Port Terminal Access (Bulk Wheat) Code of Conduct.

NBN Co SAU variation Communications Undertaking variation Finalised
April 2017

On 27 May 2016, NBN Co lodged a proposed variation to its Special Access Undertaking (SAU) with the ACCC. The Competition and Consumer Act 2010 (CCA) allows NBN Co to give the ACCC a variation to an SAU already in operation. The ACCC accepted NBN Co’s current SAU on 13 December 2013, following an extensive consultation process.
