Water trading rules: advice to the Murray Darling Basin Authority about section 12.02 Water Policy advice Finalised

On 3 March 2020, the Murray-Darling Basin Authority (MDBA) requested the ACCC provide its advice on the operation of sub-sections 12.02(2) to (4) of the Basin Plan water trading rules (the 12.02 provisions), to inform its review of these provisions as required under the Basin Plan 2012 (Cth). The ACCC provided this advice to the MDBA on 1 June 2020.

The ACCC has completed its second annual review of Water NSW’s regulated charges for water infrastructure services in the Murray-Darling Basin. This review applies to charges for 2016-17, the third and last year of the regulatory period 2014–17.

WaterNSW: Decisions under Part 6 of the Water Charge Rules 2010 Water Review Finalised

The ACCC is required under Part 6 of the Water Charge Rules 2010 (WCR) to decide whether on-river infrastructure operators meet the definition of ‘Part 6 operators’ and, if so, whether to grant them an exemption from the operation of the requirements of Part 6 of the WCR.

In April 2011, following further consultation with industry participants, the ACCC decided not to commence a declaration inquiry.

On 16 December 2011 the ACCC commenced an inquiry into declaration of wholesale ADSL services under section 152AL of the Competition and Consumer Act 2010 (the Act).

The ACCC issued a discussion paper inviting submissions on whether declaration of wholesale ADSL services would promote the long-term interests of end-users.

On 14 February 2012 the ACCC decided to declare the wholesale ADSL service under section 152AL(3) of the Act.

On 30 July 2021 the ACCC commenced a public inquiry, under Part 25 of the Telecommunications Act 1997, into the declared wholesale asymmetrical digital subscriber line (WADSL) service. The ACCC has released a Consultation and position paper to facilitate its inquiry.
