On 12 October 2022 Wagner Corporation Pty Ltd applied to the ACCC seeking to be determined an exempt service provider of port terminal services at its port terminal facility at Pinkenba, Queensland. On 12 December 2022 the ACCC released a final determinations document confirming that it has determined Bulk Cargo Services Pty Ltd and Wagner Corporation Pty Ltd to be exempt service providers of port terminal services at their respective port terminal facilities at Pinkenba, Queensland.

On 29 March 2022, NBN Co lodged a variation to its Special Access Undertaking (SAU) with the ACCC. NBN Co's proposed SAU variation followed an extensive industry consultation process hosted by the ACCC during the second half of 2021 to consider the future regulatory framework for the NBN.

On 10 October 2022 the ACCC sent a letter to ARTC regarding the potential timing of assessing a replacement undertaking.  On 19 December 2022 ARTC provided a letter to stakeholders outlining its intent to submit a new 2023 IAU and a further extension of the 2008 IAU in early 2023.

On 3 September 2021, Port of Portland Pty Limited applied to the ACCC to be determined an exempt service provider of port terminal services at its port terminal facility at Portland, Victoria. On 3 May 2022 the ACCC released a final determination document confirming that it has determined Port of Portland Pty Limited to be an exempt service provider of port terminal services at its Portland facility. The exemption was made by notifiable instrument.
