The ACCC and ASIC have jointly produced this guideline which aims to assist creditors, collectors and debtors understand their rights and obligations, and ensure that debt collection activity is undertaken in a way that is consistent with consumer protection laws.
These guidelines set out how the ACCC will interpret Part XICA of the Competition and Consumer Act 2010 (Cth) (CCA) and they explain the general approach the ACCC will take in investigating alleged contraventions of Part XICA. They include a number of examples of the types of conduct that the ACCC considers are likely or unlikely to contravene Part XICA.
This document supplements the ACCC immunity and cooperation policy for cartel conduct – October 2019. The frequently asked questions may be amended from time to time to address issues that may arise in the application of the policy.
