(i) Australian Building Construction Employees - s.87B undertaking

The Builders Labourers' Federation, QLD Branch ("BLF") and Daryl Kerr, have undertaken not to engage in any conduct in Queensland from which any person is hindered or prevented, or threatened to be hindered or prevented from acquiring or supplying mobile crane hire services for the reason that that person does not have an Enterprise Bargaining Agreement with the BLF or any other union. The BLF also undertook to uses its best endeavours to ensure that its employees and members do not cause or procure damage to any person for or on account of that person having assisted the Commission in its enquiries. The BLF has undertaken to establish a trade practices compliance program to ensure all of its employees are aware of their obligations under section 45D of the Trade Practices Act 1974.
