Copperart Pty Ltd - s.87B undertaking

Copperart is a retailer of consumer and household goods, with stores in all States and Territories of Australia. It came to the Commission's attention that Copperart stores displayed information by way of signs, setting out a particular policy regarding exchanges and refunds. However a contradictory policy, that, in the Commission's view, misrepresented the statutory rights of customers to exchanges and refunds, appeared on the cash register receipts from the same stores. In response Copperart revised in-store signage and removed the policy from cash register receipts.

Copperart undertook to publish an apology to consumers who may have been misled by the exchange or refund policies on display, offering exchanges, and in some cases, refunds. Copperart also undertook to prevent, so far as is reasonably possible, any contraventions of the Trade Practices Act 1974 by Copperart, its directors, servants or agents, and to create and maintain a trade practices compliance program consistent with the relevant Australian standard.
