The parties were involved in price-fixing and market sharing conduct in the Queensland Fire Protection industry in breach of Sections 45(2)(a)(ii) and 45(2)(b)(ii) of the Trade Practices Act 1974. The companies have agreed to implement a trade practices compliance program and code of conduct for tendering to prevent future contraventions of the Act by company officers, employees or agents. Wild and Spurr will use their best endeavours to enable Enterprise Fire Protection Pty Ltd ("EFP") to pay the pecuniary penalty and if EFP fails to meet its obligations will be personally liable for a portion of the penalty. Prickett and Taylor will use their best endeavours to ensure Enterprise Fire Protection Electrics Pty Ltd ("EFPE") can meet its obligation to pay its pecuniary penalty.
