Market definition

The ACCC considered the possibility of separate product markets for the manufacture and supply of different waste truck bodies - for example side, rear, front and other types of truck lift bodies. The ACCC considered that these product markets were likely to exist on a national basis. However, it was not necessary for the ACCC to reach a conclusive view on market definition as the outcome of the competition assessment would not have been affected.

Competition analysis

The ACCC considered that the acquisition would be unlikely to substantially lessen competition due to the:
- lack of significant overlap with the operations of Transpacific;
- competitive constraint likely to be imposed on Transpacific by other competitors; and
- ability of consumers to exercise countervailing power.
