Market definitionThe ACCC considered the completed acquisition in the context of separate markets for the supply of shoring and pump equipment for hire in Victoria, New South Wales and Queensland. The ACCC noted that the geographic dimension of the market was likely to be narrower than State based markets. However, for the purposes of assessing the completed acquisition the ACCC did not consider it necessary to form a concluded view on geographic scope of the market.
Competition analysisThe ACCC considered that the completed acquisition would not result in a substantial lessening of competition in any of the relevant markets due to the following factors:
* the merged entity would continue to be constrained by existing rivals;
* barriers to entry and expansion do not appear significant; and
* some large customers may have a degree of countervailing power, by being able to purchase shoring or pump equipment themselves.
