Nonetheless, the ACCC considered the competitive effects of the completed acquisitions in local markets for the retail sale of hardware and home improvement products.The ACCC also found that there are regional markets for the wholesale supply of hardware and home improvement products to retailers but considered that the completed acquisitions had little impact on the relevant wholesale markets.
Competition analysis
The ACCC considered that the acquisitions were unlikely to substantially lessen competition for reasons particular to each completed acquisition.With respect to the site at Hervey Bay, while barriers to entry into hardware retailing are substantial, this acquisition does not affect the likelihood of entry into that market due to the likely availability of alternative suitable sites. Accordingly the ACCC considered that the completed acquisition is not likely to result in a substantial lessening of competition by preventing an alternative hardware retailer from acquiring the site.
With respect to the site at Mentone, in assessing the completed acquisition against the likely counterfactual of a new entrant acquiring the site, the ACCC considered that the completed acquisition would be unlikely to substantially lessen competition due to the existence of other competitors in the local market as well as the availability of alternative sites.
