The ACCC investigated Planet Earth Design Concepts Pty Ltd ('Planet Earth'), trading as Churinga Designs, in relation to conduct which the Commission alleged was in breach of the resale price maintenance provisions of the Trade Practices Act 1974.
The ACCC investigated a complaint received in relation to the labelling of YBDs "Nana Divers Classic Baked Muesli Slice" range. The complaint was in relation to the use of the words "Product of Australia" on the labelling.
After conducting market inquiries, the Commission determined that the acquisition of BOC Australia Pty Ltd by a specifically formed acquisition vehicle owned jointly by Air Products & L'Air Liquide would not substantially affect competition, provided that certain guarantees were provided by the parties, to the ACCC.
