The ACCC has accepted a section 87B Undertaking from Utel Networks Pty Ltd (Utel) following an investigation relating to breaches of the Australian Consumer Law (ACL), contained in Schedule 2 of the Competition and Consumer Act 2010 (the Act).
On 16 April 2014, the ACCC decided to extend the existing the final access determinations (FADs) for the declared fixed line services (LCS, WLR, LSS, ULLS, PSTN OA (FOAS as of 1 August 2014), PSTN TA (FTAS as of August 1 2014) and the wholesale ADSL service. The ACCC is extending these FADs as it will not be in a position to make the new fixed line services and the wholesale ADSL service FADs prior to their expiration.
The ACCC has accepted a Section 87B Undertaking from FOXTEL Management Pty Ltd (FOXTEL) following an investigation relating to alleged breaches of the Australian Consumer Law (ACL), comprising Schedule 2 to the Competition and Consumer Act 2010.
On 18 April 2013, the ACCC consented to a Variation to the section 87B Undertaking given by Nestlé S.A. on behalf of itself and its subsidiaries, Nestlé Australia Ltd, and Duke Holdco Pty Ltd (together, Nestlé) and accepted by the ACCC on 22 November 2012 (the Undertaking) (the Variation).
This statement of differences was given to the ACCC on 28 February 2013 by CNT Corp Pty Ltd with respect to an access agreement entered into by Clear Networks Pty Ltd with CNT Corp Pty Ltd. This access agreement contains differences from the Local Bitstream Access Service Final Access Determination (FAD) that was published by the ACCC on 3 October 2012.
