Summary

On 3 September 2018 the ACCC received a collective bargaining notification from Victorian Off - Course Agents Association (VOCAA) to collectively negotiate the terms of a Distribution Services Agreement on behalf of its current and future TAB agency members with Tabcorp Wagering (Vic) Pty Ltd (Tabcorp) for the provision of services as agent of Tabcorp.

Victorian Off-Course Agents Association (VOCAA) represents stand-alone off-course TAB agencies in Victoria who have been appointed by the target, Tabcorp to act as agents in respect of the provision of off-course wagering services to Tabcorp. VOCAA proposes to negotiate the terms of an agreement on behalf of its current and future TAB agency members.

It is expected that each participant in the proposed collective bargaining arrangements will enter into a separate agreement with Tabcorp.  The current Distribution Services Agreement expires on 30 June 2019 and VOCAA proposes to commence negotiating the terms of a new agreement with Tabcorp on behalf of the TAB agencies in late 2018 or early 2019.

On 27 September 2018 the ACCC decided not to object to the notification, enabling VOCAA to collectively negotiate with Tabcorp.  The ACCC decided to allow the immunity provided by the notification to remain in force for ten years from the date it was lodged.  Accordingly, the notification came into force on 17 September 2018 and will remain in force until 2 September 2028, unless it is withdrawn or revoked.
