Summary

KIS Transport Australia Pty Ltd (KIS Transport) is seeking to negotiate on behalf of itself, five other freight brokers and future freight brokers that may become members of the group (Contracting Parties), agreements with current and future freight carriers whose services will be sold to customers of the Contracting Parties.

The current Contracting Parties are KIS Transport, Hydra Logistics Solutions Australia Pty Ltd, Total Freight Logistic Services Pty Ltd, Transfreight Solutions Australia Pty Limited and KIS Corporate Pty Ltd. The Contracting Parties provide freight broking services, which connect a customer who wants to send freight to a freight carrier, while also managing other aspects of the supply chain for that customers (such as insurance, freight monitoring, warehousing and customer services).

The current targets that the group intends to negotiate with include TNT, TOLL Express, Couriers Please, Followmont Transport, Hi-Trans Express and Northline.

Collective bargaining would be voluntary for the Contracting Parties and would not include a collective boycott. KIS Transport Australia Pty Ltd has requested the notification last for a period of six years to cover the terms of the contracts (typically 1-5 years long) and any pre-contractual negotiations.

On 23 April 2021 the ACCC did not to object to the notification and decided to allow it to stand for 6 years. The legal protection provided by the notification commenced on 4 January 2021 and it will remain in force until 20 December 2026, unless it is withdrawn or revoked.
