Description of Conduct

On 11 November 2024 Wilmar Sugar Trading Pty Ltd, Wilmar Sugar Pty Ltd, Tully Sugar Limited, MSF Marketing Pty Ltd, Queensland Commodity Service Pty Ltd, Bundaberg Sugar Ltd and Queensland Sugar Limited (together, the Applicants) lodged an application for authorisation to collectively negotiate, execute and give effect to new storage and handling agreements with Sugar Terminals Ltd (STL) in relation to the provision of storage and handling services at the six bulk sugar terminals (BSTs) of STL in Queensland.

Authorisation was sought for 5 years.

The Applicants also requested interim authorisation to negotiate and execute (but not give effect to) storage and handling agreements, for the provision of services at the BSTs with STL, prior to the ACCC’s final determination in relation to this application.

On 30 January 2025, the ACCC issued a draft determination proposing to grant authorisation in respect of the proposed arrangements for 5 years.

On 30 January 2025, the ACCC also granted interim authorisation to allow the Applicants to negotiate and execute (but not give effect to) storage and handling agreements, for the provision of services at the BSTs with STL. 

On 12 March 2025, the ACCC decided to grant authorisation for 5 years, until 3 April 2030. A copy of the ACCC’s final determination is available under the Decisions heading below.
