Description of Conduct
On 28 February 2022, the State of Western Australia as represented by the Department of Health (the Department) lodged an application for authorisation AA1000605.
The Department sought authorisation on behalf of itself, specified private healthcare providers operating in West Australia, and all Western Australian public hospitals and other healthcare facilities, to negotiate and enter into agreements with each participating private healthcare provider, under which the Department will provide funding and those providers will provide resources and services to the overall response to COVID-19 in West Australia being coordinated by the Department.
The Department also sought authorisation on behalf of other private healthcare providers notified to the ACCC from time to time.
On 17 March 2022, the ACCC issued a draft determination proposing to grant authorisation and granted interim authorisation.
On 27 May 2022, the ACCC issued a final determination granting authorisation until 24 June 2023. Authorisation is granted with a condition which requires reporting of conduct engaged in under the authorisation on a quarterly basis.
