Summary
Tabcorp Wagering Manager (Vic) Pty Limited, TAB Limited and Tabcorp Europe Limited (collectively referred to as Tabcorp or the Applicants) are seeking authorisation to make and give effect to pooling arrangements with the HKJC Horse Race Betting Limited (HKJC).
The agreements will govern Tabcorp's (and in respect of Tabcorp Europe - Premier Gateway International's) participation as a guest in pools on Hong Kong racing operated by the HKJC. In particular, Tabcorp has identified four provisions that may raise concerns under the Competition and Consumer Act 2010 (the CCA) - these are referred to as the 'Betting Rules Requirement', 'Rebate Restriction', 'Geographic Restriction' and the 'Betting Restriction'.
In the event Tabcorp's acquisition of ACTTAB's assets is successful, Tabcorp also sought authorisation to make and give effect to potential future arrangements between a Tabcorp entity and HKJC on substantially similar terms to enable bets placed with ACTTAB to also be pooled into Hong Kong.
Tabcorp requested interim authorisation to make and give effect to the proposed agreements.
On 24 September 2014, the ACCC granted interim authorisation to allow Tabcorp to make agreements with HKJC that contain four provisions identified by Tabcorp as potentially raising concerns under the CCA, and to give effect to those provisions. These provisions are referred to as the: Betting Rules Requirement, Rebate Restriction, Geographic Restriction and Betting Restriction.
On 29 October 2014, the ACCC issued a Draft Determination proposing to grant authorisation for seven years to Tabcorp Wagering Manager, TAB, TAB Europe and Tabcorp ACT to enter into pooling agreements with HKJC that contain any of the Specified Provisions (as set out in Paragraph 4 of the Draft Determination), and give effect to those Specified Provisions.
On 12 February 2015, the ACCC granted authorisation for Tabcorp Wagering Manager (Vic) Pty Ltd, TAB Limited, Tabcorp Europe Limited and Tabcorp ACT Pty Ltd to enter into pooling agreements with HKJC Horse Race Betting Limited that contain any of the Specified provisions (as set out at paragraph 4 of the determination), and give effect to those Specified Provisions. Authorisation is granted until 12 February 2022 (seven years).
