Summary
Tabcorp has existing agreements with Racing and Wagering Western Australia (RWWA) and ACTTAB Limited (ACTTAB) governing their participation in the SuperTAB pool. Both agreements expire on 14 August 2012. These agreements were authorised by the ACCC on 9 September 2009.
At the time authorisation was sought and granted it was understood that Tabcorp's Victorian wagering licence expired on 14 August 2012 and for this reason the agreements terminate on this date. Tabcorp has since become aware that its existing Victorian wagering licence expires on 15 August 2012. As a result Tabcorp has entered into letter agreements extending its agreements with RWWA and ACTTAB re participation in the SuperTAB pool by one day, until 15 August 2012. Minor variation is sought to extend the term of the authorisation by one day to cover the extended agreements.
On 27 June 2012 the ACCC gratned authorisation to the minor variation.
