Description of Conduct

On 15 July 2025, South Australian Chamber of Mines and Energy Inc (SACOME) lodged application for authorisation AA1000701. SACOME sought authorisation on behalf of itself and Participating Members to establish a joint electricity buying group, jointly tender and negotiate electricity supply agreements, and to make and give effect to electricity supply agreements with the preferred electricity supplier/s.

Each Participating Member will individually meet the definition of a large electricity customer in South Australia under the National Energy Retail Law. The total combined annual electricity consumption of the Participating Members will not exceed 5% of the total annual electricity consumed in the South Australian region of the National Electricity Market.

Authorisation was sought for 12 years.

On 24 September 2025, the ACCC issued a draft determination proposing to grant authorisation for 12 years. The ACCC also granted interim authorisation to enable SACOME and Participating Members to commence the tender and negotiation processes while the ACCC completes its assessment of the substantive application. Interim authorisation did not extend to the making or giving effect to any agreements with electricity suppliers.

On 22 October 2025, the ACCC issued a final determination granting authorisation for 12 years, until 13 November 2037.
