Description of Conduct
On 3 December 2021, the State of South Australia, as represented by the Department for Health and Wellbeing (the Department) lodged an application for authorisation AA1000591.
The Department behalf of itself, specified private healthcare providers operating in South Australia, and all South Australian public hospitals and other healthcare facilities, seeks to negotiate and enter into agreements with each participating private healthcare provider, under which the Department will provide funding and those providers will provide resources and services to the overall response to COVID-19 in South Australia being coordinated by the Department.
The Department also sought authorisation on behalf of other private healthcare providers notified to the ACCC from time to time.
On 8 December 2021, the ACCC issued a draft determination proposing to grant authorisation and granted interim authorisation.
On 23 March 2022, the ACCC issued a final determination granting authorisation for 18 months, until 24 June 2023. Authorisation is granted with a condition which requires reporting of conduct engaged in under the authorisation on a quarterly basis.
