Description of Conduct
Screen Producers Australia, on behalf of itself and its current and future members, seeks authorisation for 7 years to collectively bargain with providers of subscription video on demand platforms which will be subject to the Commonwealth’s legislated obligation to spend a minimum amount on Australian content (referred to as Regulated Streamers).
Specifically, SPA seeks authorisation to:
- to collectively negotiate model terms of engagement with Regulated Streamers for the licensing of Programs produced by Members;
- to make and give effect to new contracts or arrangements with the Regulated Streamers that contain appropriate instances of the model terms of engagement (having regard to the nature and financing arrangements of the particular Program) and to give effect to those new contracts or arrangements;
- if SPA so resolves in response to refusal by Regulated Streamers to negotiate, to resolve model terms of engagement and make them available to all members of SPA (but not collectively boycotting the Regulated Streamers who do not accept the model terms of engagement).
SPA has also sought interim authorisation to commence the proposed conduct prior to the ACCC’s final determination on the authorisation application.

Concurrent consideration of authorisation applications
