Description of Conduct
On 28 June 2024, ResiLoop Limited (ResiLoop) lodged an application for authorisation to establish and operate a voluntary, industry-led product stewardship scheme to collect and recycle resilient flooring waste (Scheme). The Scheme will be funded by a product levy of no more than 15 cents per square metre applied to certain categories of resilient flooring products. The product levy will be passed transparently through the value chain (e.g. by direct reference on the invoice to the scale of the product levy and the relevant products included in the purchase).
ResiLoop sought authorisation on behalf of itself, its members and participants in the Scheme for a period of 6 years.
ResiLoop also sought interim authorisation for all aspects of the Scheme.
On 16 August 2024, the ACCC issued a draft determination proposing to grant authorisation for a period of 6 years. The ACCC also granted interim authorisation to enable ResiLoop to establish and operate the Scheme while the ACCC considered the substantive application.
On 21 November 2024, the ACCC issued a final determination granting authorisation for a period of 6 years, until 13 December 2030, as sought.
