Description of Conduct
Refrigerant Reclaim Australia Limited (RRA) applied for re-authorisation to continue to operate a product stewardship scheme to recover ozone depleting and synthetic greenhouse gas refrigerants (the Conduct) on 2 December 2020.
RRA is the industry funded not-for-profit product stewardship organisation that recovers, reclaims and destroys ozone depleting and synthetic greenhouse gas refrigerants. The product stewardship program is funded by a levy on the import and sale of new refrigerants that is currently authorised under authorisation A91515. Authorisation A91515 is due to expire on 28 May 2021.
RRA seeks re-authorisation for at least five years. The RRA scheme was first authorised in 1994.
On 30 March 2021, the ACCC issued a draft determination proposing to authorise Refrigerant Reclaim Australia to engage in the Conduct for 10 years.
On 11 May 2021, the ACCC re-authorised the conduct for 10 years until 3 June 2031. Having regard to Refrigerant Reclaim Australia’s commitment to publish information the subject of the previous conditions of authorisation and having received no submissions from interested parties on this issue, the ACCC has not reimposed these conditions.
