Description of Conduct

On 21 August 2020, the National Honda Dealer Council (NHDC) applied for authorisation on behalf of itself and a group of Honda Australia dealers, to discuss and collectively negotiate with Honda Australia issues arising from Honda Australia's termination of existing dealer agreements and their replacement with a new agency model. Discussions and negotiations may cover terms and information including in relation to commissions, compensation for termination of existing arrangements and arrangements for finance, insurance, oil, aftermarket products and accessories.

The NHDC has also sought interim authorisation to facilitate immediate engagement with Honda on Honda’s proposed transition to the new agency model.  

On 16 September 2020, the ACCC granted interim authorisation to the NHDC to share information and to commence collective bargaining with Honda Australia. The full interim authorisation document is available below. Interim authorisation will remain in place until revoked by the ACCC, or the date on which the ACCC's final determination comes into effect.

On 2 December 2020, the ACCC granted authorisation until 31 July 2026.
