Description of Conduct

The Melbourne councils of Bayside, Cardinia Shire, Casey, Frankston, Glen Eira, Greater Dandenong, Kingston and
Monash (together, the Participating Councils) propose to jointly procure organic waste processing services. The
Metropolitan Waste Management Group (MWMG), a Victorian statutory body corporate whose role is to coordinate joint
procurements of this kind, proposes to act on the Participating Councils' behalf and facilitate the procurement,
negotiation and contracting process, and participate in the ongoing administration of the relevant supply contracts.
The applicants also seek authorisation for exclusionary provisions in respect of the contracts, arrangements or
understandings that:
-may be made between those Participating Councils that ultimately enter into in the proposed contractual framework set out
in the supporting submission; and
-relate to the supply of organic waste to, or allocation of organic waste volumes between, any of the suppliers that choose to
enter into that contractual framework.
The parties seek authorisation for a total period of 18 years, comprising: a three-year period for the remainder of the joint
procurement process, the negotiation/execution of the contracts and the construction/commissioning of the new facilities;
and a proposed 15-year operating term.

On 18 June 2014, the ACCC issued a final determination authorising the conduct until 10 July 2032.
