Description of Conduct
On 14 October 2021, the City of Hobart Council, Glenorchy City Council and Kingborough City Council (the Councils) applied for authorisation to collectively tender and contract for Food Organics and Garden Organics (FOGO) processing services, including acceptance, sorting and disposal. Authorisation is sought for 4 years and 6 months to cover the initial procurement process and contracts for the provision of services.
The Councils have also requested interim authorisation to allow them to progress the tender process, with a view to identifying the preferred tenderer, commencing the negotiation process with the preferred tenderer and preparing the ensuing contractual documents.
On 31 March 2022, the ACCC issued a draft determination proposing to grant authorisation for 4 years and 6 months.
The ACCC also granted interim authorisation to enable the councils to conduct the tender process. Interim authorisation was not sought, and has not been granted, for the councils to enter into any contracts arising from the tender process.
On 16 June 2022, the ACCC issued a determination granting authorisation until 8 December 2026.
