On 19 January 2022, CALMS Ltd (CALMS) sought re-authorisation to continue the use of its ‘not to exceed’ fee schedule in the provision of after-hours primary medical care in the ACT (the Conduct).
CALMS sought authorisation for 10 years. CALMS also requested that the ACCC grant interim authorisation due to the existing authorisation expiring on 20 March 2022.
On 24 February 2022, the ACCC issued a draft determination proposing to grant re-authorisation for 10 years. In the draft determination, the ACCC also granted interim authorisation to allow the Conduct to continue while the ACCC completes its assessment of the application for re-authorisation.
On 13 April 2022, the ACCC granted re-authorisation until 5 May 2023.
