Description of Conduct
On 18 March 2025, the Battery Stewardship Council Ltd (the BSC) lodged an application to revoke authorisation AA1000476 and substitute authorisation AA1000694.
The BSC sought authorisation for itself, its current and future members, and other industry participants to continue operating the Battery Stewardship Scheme (the Scheme) where participants apply a levy to imported or manufactured batteries and are required to prioritise dealing with other participants of the Scheme. Under the Scheme, the levy is passed down to consumers and is used to fund the Scheme’s battery collection, sorting and processing, and the Scheme’s investment activities focused towards addressing the environmental, safety or educational and behavioural objectives of the Scheme.
This BSC also sought interim authorisation to commence implementing changes to the previous Scheme, including adjustments to the levy and rebate calculations.
The BSC sought authorisation for 5 years.
On 4 June 2025, the ACCC granted interim authorisation with a condition for the BSC to continue the Scheme with the ability to make adjustments to the levy and rebate calculations while the ACCC assessed the substantive application for authorisation.
On 28 August 2025, the ACCC issued a draft determination proposing to grant authorisation with conditions for 5 years.
On 3 November 2025, the ACCC issued a final determination granting authorisation with conditions for 5 years, until 30 November 2030.
