Description of Conduct
On 21 June 2021, the Australian Competition and Consumer Commission (the ACCC) received an application for authorisation from Barwon Region Water Corporation (Barwon Water), Barwon Health and GeelongPort Pty Limited (GeelongPort) (the Applicants).
This application relates to the creation of a joint renewable energy purchasing group – the Barwon Region Renewable Energy Project. The Applicants propose to conduct a joint request for proposal (RFP) and collectively negotiate a ‘virtual’ Power Purchase Agreement (PPA) with a generator of renewable energy. The PPA would source green benefits, in the form of Large-scale Generation Certificates, and include a Contract for Difference (based on the difference between an agreed fixed price and the National Electricity Market (NEM) spot price) for a defined volume of electricity.
On 29 July 2021, the ACCC issued a draft determination proposing to grant authorisation and granting interim authorisation.
On 26 August 2021, the ACCC issued a final determination granting authorisation for 12 years and 6 months, until 30 March 2034.
