Description of Conduct

On 28 April 2025, the Australian Screen Directors Authorship Collecting Society Ltd (ASDACS) lodged application for revocation of authorisation AA1000474 and substitution of new authorisation AA1000698, on behalf of its current and future members, to maintain the amendments made to its constitution in accordance with its existing Authorisation AA1000474.

The relevant clauses are listed below:  

  1. Clause 3.1(b), whereby ASDACS requires that as a condition of membership, members must assign to ASDACS all future copyright, and any past or present copyrights they hold in relation to the ‘Retransmission Scheme’ (as set out under section 98(6) of the Act).
  2. Clause 5, which provides that ASDACS will administer the collection and distribution of income attributable to director members under the Retransmission Scheme; and
  3. Clause 4.2(b), which provides after a minimum period of 12 months and with a minimum of three months’ notice, members may resign from ASDACS and require the reassignment of their copyrights from ASDACS.

ASDACS sought authorisation for 10 years.

On 2 July 2025, the ACCC issued a draft determination proposing to grant authorisation to ASDACS for 10 years.

On 30 July 2025, the ACCC issued a determination granting authorisation until 21 August 2035.
