Description of Conduct

On 12 October 2022, the Australian Property Institute Limited (API) applied for minor variation of authorisation AA1000553. This authorisation was granted for 5 years on 25 August 2021 in respect of certain membership requirements and obligations under API’s Constitution, Membership Policy, Code of Ethics, Standards Steering Committee Charter, CPD Policy, Rules of Professional Conduct, and Professional Conduct Policy Suite.

The authorisation allows API to give effect to arrangements setting standards of professional behaviour and imposing certain memberships and sanctions on its members.

API sought minor variation to the authorisation to include amendments made to its Constitution, which were approved at API’s Annual General Meeting on 25 May 2022. The minor variations sought related to:

  • The powers of API’s Board of Directors (the Board) to admit and reject applications for membership
  • the conditions under which persons cease to be members of API
  • the Board’s ability to make policies for its members.

On 14 December 2022, the ACCC issued a determination granting the minor variation. Authorisation AA1000553 will remain in place until 25 August 2026.  A copy of the ACCC's determination is below.
