Description of Conduct

On 26 April 2024, the Australian Dental Association Inc (the ADA) lodged an application for revocation of authorisation AA1000638 and substitution of a new authorisation AA1000669.

The ADA was seeking authorisation for the making of and giving effect to contracts, arrangements and understandings between 2 or more dental practitioners as to the fees to be charged for dental services provided within shared practices. Authorisation was sought for a period of 5 years.

The ADA also requested interim authorisation to allow shared practices to continue to engage in the conduct covered by the authorisation while the ACCC conducted its assessment of the substantive application. On 6 June 2024, the ACCC granted interim authorisation to enable dental practitioners to continue to agree on the fees to be shared for dental services provided within a shared practice.

On 1 August 2024, the ACCC issued a draft determination proposing to grant authorisation for 5 years.

On 11 September 2024, the ACCC issued a final determination granting authorisation for 5 years, until 3 October 2029.
