Description of Conduct

The Applicants seek authorisation to discuss, make and give effect to arrangements regarding the sequencing and timing of scheduled maintenance works, and associated shutdowns and outages, at each of their liquefied natural gas facilities in Curtis Island in the Port of Gladstone (LNG Facilities). The proposed conduct seeks to limit the extent to which scheduled maintenance works occur concurrently at the LNG Facilities.

On 18 February 2016, the ACCC issued a draft determination proposing to grant conditional authorisation for five years. The condition of authorisation would require the Applicants to publicly disclose maintenance information that they have shared among themselves.

On 18 February 2016, the ACCC also granted interim authorisation subject to the same condition.

On 14 April 2016, the ACCC granted conditional authorisation for five years. The condition requires the Applicants to publicly disclose maintenance schedule information that they have shared with one another, and to ensure that information remains accurate.
