On 23 May 2014, the ACCC commenced a public inquiry into making a final access determination for the Mobile Terminating Access Service. The ACCC commenced consultation on the primary price terms, with the release of a consultation paper on 1 August 2014.

The ACCC is consulting separately on non-price terms and conditions for the Mobile Terminating Access Service. On 25 March 2015, the ACCC released its draft decision on non-price terms and conditions, following a joint consultation process for a number of declared services, including the Mobile Terminating Access Service.

On 6 May 2015, the ACCC released a draft decision on the primary price terms for the Mobile Terminating Access Service final access determination.

On 24 August 2015, the ACCC released a final decision on the primary price terms for the Mobile Terminating Access Service final access determination. The ACCC also released separately a final decision on the non-price terms and conditions for the Mobile Terminating Access Service final access determination.

Background

The Mobile Terminating Access Service final access determination inquiry will determine the price and non-price terms and conditions for the Mobile Terminating Access Service. These terms and conditions will apply where there is no commercial agreement between an access seeker and the access provider. The final access determination made will create a benchmark that the parties can fall back on when they are unable to negotiate access terms and conditions.

The ACCC commenced consultation on non-price terms and conditions on 23 May 2014, with the release of a position paper seeking views on non-price terms and conditions including the Mobile Terminating Access Service. This consultation was concluded on 24 August 2015. The common non-price terms and conditions determined in this consultation process apply to the Mobile Terminating Access Service.
