Regulatory projects

Following pre-lodgement discussions, in January 2021 ADM Trading Australia applied to the ACCC seeking to be determined an exempt service provider of port terminal services provided through a terminal facility at Port Pirie, South Australia.

On 18 June 2021, the ACCC hosted an industry roundtable to commence a process to consider the regulatory framework for the NBN.

On 10 August 2021, the ACCC released a final determination for the period 1 January to 31 December 2018. The ACCC's final determination is that ARTC's revised submission from 17 June 2021 is in accordance with all requirements under the HVAU. The submitted true-up test audit is also in accordance with HVAU requirements.

On 14 October 2019, the ACCC commenced a public inquiry into the prices that NBN Co charges access seekers to use the National Broadband Network (NBN) for supplying residential grade broadband services. The ACCC is considering whether regulatory intervention is necessary in respect of these access products, particularly basic speed access products.

On 11 September 2014, the ACCC commenced a declaration inquiry into whether a superfast broadband access service, such as the very-high-bit-rate digital subscriber line (VDSL) service, should be regulated under the Competition and Consumer Act 2010.

On 2 July 2019, Viterra provided a written application to the ACCC seeking to be determined an exempt service provider of port terminal services provided by means of all six of their port terminal facilities located in South Australia.

The ACCC has concluded its public inquiry into regulation of the superfast broadband access service (SBAS) and the local bitstream access service (LBAS).

On 23 April 2021, ARTC submitted an application to extend the term of its 2008 Interstate Access Undertaking to 30 June 2023.

On 30 March 2021, the Australian Rail Track Corporation (ARTC) submitted a new variation application for the current Hunter Valley Coal Network Access Undertaking. The ACCC published its Final Decision to consent to ARTC's 30 March variation application on 2 June 2021.

On 23 December 2020, the Australian Rail Track Corporation (ARTC) applied to the ACCC to vary the Hunter Valley Coal Network Access Undertaking. On 30 March 2021, ARTC withdrew its 23 December 2020 variation application and submitted a new variation application.
