Viterra has 6 bulk wheat port terminal facilities in South Australia and is currently regulated by the Port Terminal Access (Bulk Wheat) Code of Conduct (code). The code regulates bulk wheat port terminal operators to ensure that exporters have fair and transparent access to terminal facilities.
On 5 July 2022, Viterra published a notice on its website inviting applications for long-term capacity under a new set of Port Loading Protocols, including changes to its capacity allocation system, effective 1 October 2022. Viterra notified the ACCC of the proposed changes on 6 July 2022.
On 25 July 2022, the ACCC commenced a targeted consultation process on the proposed variation to Viterra's capacity allocation system. Submissions to the consultation process were due on 2 August 2022.
On 31 August 2022, the ACCC approved Viterra's capacity allocation system as varied.
