Following consultation with stakeholders, the ACCC, published an initial draft decision on 6 August 2009 stating that CBH's original April proposal was not likely to be acceptable, and likely required changes.

On 6 August 2009, the ACCC released its draft decision not to accept Co-operative Bulk Handling Ltd's (CBH) Access Undertaking.

During the course of the assessment process, CBH also provided proposed standard terms and conditions of access to its port terminals services, and a revised version of its Port Terminal Rules.
