In June 2013, ARTC submitted a proposed variation to the accepted Hunter Valley access undertaking to the ACCC for assessment under Part IIIA of the Competition and Consumer Act 2010 (the Act).
The proposed variation relates to an extension of the coverage of the undertaking to include the Gap to Turrawan Segments of the Hunter Valley Rail Network. On 20 February 2014, ARTC withdrew its proposed variation.
On 24 March 2014, ARTC submitted a revised application to the ACCC. The ACCC accepted the revised application on 25 June 2014 after having sent a letter to industry in April 2014 seeking comments on ARTC’s proposal.
